THE present little Work was originally written at the request of the Society for the Diffusion of Useful Knowledge, in order that it might be published under their superintendence. Recent circumstances having induced that Society to abandon the contemplated publication of a series of popular Treatises upon legal subjects, it is now, at their instance, presented through another channel. In order that the unprofessional reader may the more readily obtain the information he desires, the Author has treated the two branches of the entire subject as distinct, notwithstanding the risk he may incur of being censured for repetition.
