to impound all Cattle unmarkt or any Horses wch broke into the sd Common, or he found there. He was usualy put in by the Lord of the Mano Bayliff, and allowed by the Commoners and paid by them, for his pains & care. When the Church was to be new built the Common was inclosed by the consent of Charles Cheyne Esq' Lord of the Several Proprietors for 21 years to defray part of the Charges by a Lease bearing date March 25, 1674. And the Persons therein named to have right are these

The lease was executed by these persons, their Trustees & their under Tenants, and thereby let to Georg Hill & ffrancis Guilford, who inclosed the same & quietly enjoyed the common so inclosed unto Michmas 1695. When it was thrown open again. ffrom Michmas 1694 to Michmas 1695 Natthan Tirrett grazed it by taking in Beasts & with some of his own. He paid me That years Tithes for the same at the Rate of 30 acres (the rest for pitts & high wayes abated) at the rate of 48 p acre-6:00:00.

And so I understand Dr. Littleton recd., after a Suit with Samms in wch the Dr. Prevail'd & made the sd Samms pay Costs as Mr. Franklin knowes. At a Court Baron ten ffeb. 25. 1663. XVIto Caroli 2di.

Presented by a Jury to have right of Common in Chelsey Comon as followes

Item Sr Arthur Gorges Knight did in his life time above 40 yeares before for all his Houses & Lands whereunto Rt of Common did appertain by Custome hath disclaimed his Rt of Common in Consideraon of 3 acres of Medow ground over agst Battersey Church allowed him by the Lord of the Mannor wch 3 Acres heretofore was Lammas, nor any claiming under him hath right of Common, nor had nor claimed any right of Comon ever since.

Rules 1. All Cattle are to be markt with 2 lettTM by a Tar-
mark und' Penalty of.

2. The Bailiff refusing to mark shall forfeit 5 shills
