STATEMENT UNDER RULE 234.

This is an appeal taken by the defendant, Fire-
man's Fund Indemnity Company, in the above en-
titled action from the judgment of the Supreme
Court entered in the Office of the Clerk of the
County of Onondaga, New York, on the 11th day
of October, 1935, in favor of the plaintiff and
against the defendant in the sum of $3,224.85 dam-
ages and $95.95 costs, amounting in all to the sum
of $3,320.80, and from the judgment of the Su-
preme Court entered in the Office of the Clerk of
the County of Onondaga, New York, on the 14th
day of October, 1935, in favor of Frank Westlake,
Jr., a defendant in the above entitled action, under
Section 271 of the Civil Practice Act, and against
the defendant, Fireman's Fund Indemnity Com-
